When a person dies with or without a Last Will and Testament, unless the decedent’s property was held jointly, it is likely that it will be subject to formal Probate Administration. Probate administration is the Court process that transfers the title of property to the entitled beneficiaries according to law. A Guardianship is established for the benefit of a minor child(ren). A person may petition the Court for a Guardianship to be established for custody of the minor or control of the minor’s financial affairs, or both.
A Conservatorship is established for the benefit of an adult who is unable to property care for himself/herself. A person may petition the Court to be appointed Conservator to care for someone’s personal needs, financial needs, or both.
